In a bid to resolve land dispute in Nairobi county,Chief Justice Martha Koome has commissioned a multi-
agency team that will be responsible for sustainable resolutions.
According to CJ,Nairobi Land Justice Working Group comprises of all key players in the land justice sector –
that is tasked to identify the cause and address the challenges in the administration.
However,the group will engage with the public and stake holders to secure lasting solutions to disputes in lands.
The work of the group is to recommend appropriate interventions,formulate guidelines that should be implemented to seek land justice.
This will happen through adoption of innovative and effective methods to justice which will-
include Alternative Justice Systems and Court Annexed Mediation.
Consequently,the CJ said this while presiding over the unveiling initiative-
that is aligned with the goals of Social Transformation through access to Justice(STAJ).
This target that no case will stay in court for more than 3 good years.
CJ koome further stated that the commissioned group will examine causes and delay,
therefore adopting innovative justice delivery mechanisms.
“This initiative goes beyond the conventional boundaries,seeking to foster an inclusive ,participatory,
accountable,and responsive justice system that truly serves the aspirations of our people,including the most marginalized and vulnerable among us,CJ koome said.
Nairobi county is faced with issues of double allocation,mix-up during survey, encroachment of public land,advanced possession claims ,lack of zoning and enforcement,
informal settlements,renewal of leases and fraud hence creating a complex web of land injustice.
Additionally, Through Lauding ELC’s novel initiative to securing land justice.
Deputy chief Justice Philomena Mwilu stated that she will be paying attention to the outcomes of the working group –
which should form the bench mark for it’s expansion to other counties.
She told the team to embed a system of performance measurements and management that will enable them to track and improve their performance.
CS for land Alice Wahome is not left behind as she said to pledge the support of her ministry to ensure that the goals are met and land justice is achieved.
